A Brooklyn Accident Attorney Addresses The Issue Of Bicycle And Vehicle Door Collisions

Biking in New York City has become a preferred and modern mode of transportation both in the country setting and along the busy streets of Manhattan and Brooklyn. The benefits of this mode of transportation cannot be overstated. It provides exercise, convenience, and in many cases, speed. Yet, riding a bike in heavy New York City traffic can at times be hazardous.

It is not unusual to see a driver park a vehicle and exit into traffic without looking at what might be in his or her path. It is easy for a cyclist to be badly injured by crashing into the door.

It seems like a minor thing to a lot of drivers, but it is illegal for someone to open a car door on the traffic side and leave it for longer than it takes a passenger to get out or in. If your open door interferes with traffic or causes a hazard, you can face a penalty as well.

This is a New York State statute that applies throughout all the counties of the State. New York City has an additional protective law NYCCRR Section 4-12- ( c ) which provides that "no person shall get out of any vehicle from the side facing on the traveled part of the street in such manner as to interfere with the right of the operator of an approaching vehicle or bicycle."

This law is designed to protect cyclists and to outline a driver's legal responsibility. If you have been the victim of such an incident, and the offending driver is unwilling to accept responsibility, you may need to consult with a knowledgeable lawyer. You should do it as soon as possible while there is still evidence, and the incident is still fresh in the minds of witnesses on the scene.

If you have decided to get legal representation after some time has passed, it may be too late to convince a judge you should be compensated. A good lawyer may find some other way to get justice without going to court however.
